Deferred Payment Program – Terms & Conditions

Home Smith WI LLC’s deferred payment option allows qualifying homeowners to postpone payment of some or all approved pre-sale improvement costs until the sale of the property closes. Participation is subject to project approval, eligibility, and a separate written Home Smith WI LLC project agreement.

Materials & Deposits: A deposit may be required before work begins to cover materials, special-order products, subcontractor costs, permits, or other project expenses. The amount of any required deposit will be disclosed and agreed upon before work begins. Unless specifically stated otherwise in writing, the remaining approved project balance may be deferred until closing.

Payment at Closing: When the property successfully closes, the outstanding Home Smith WI LLC balance is due in full at closing or immediately from the seller upon receipt of sale proceeds, as specified in the project agreement. The seller remains ultimately responsible for payment regardless of whether closing proceeds are sufficient to cover the balance.

If the Property Does Not Sell: Deferred payment is a postponement of payment and is not contingent upon the property selling. The homeowner remains responsible for all amounts owed to Home Smith WI LLC for completed work, materials, approved change orders, subcontractor charges, and other agreed project costs.

If the property has not successfully closed within 180 days after substantial completion of Home Smith WI LLC's work, the outstanding balance becomes due in full, regardless of listing status. The balance also becomes immediately due if the property is withdrawn from the market, the listing agreement is terminated or expires without renewal, the owner elects not to sell, or ownership is transferred outside of a normal closing.

Separate Services: Home Smith WI LLC and Century 21 Affiliated provide separate services. Use of Home Smith WI LLC is not required to list a property with Damien Smith or Century 21 Affiliated, and use of Damien Smith or Century 21 Affiliated is not required to hire Home Smith WI LLC. Homeowners are free to select any contractor and any licensed real estate professional.

No representation or guarantee is made that any improvement will increase the property's value, produce a particular return on investment, result in a sale, produce a particular sale price, or cause the property to sell within any particular period. All work, pricing, deposits, deferred-payment terms, change orders, and payment obligations are governed by the applicable written Home Smith WI LLC agreement.
